What will it cost to commence a Guardianship proceeding?It depends. While the proceeding has a filing fee of $45, the cost to commence a proceeding can be as much as $12,000. However, there are ways in which some of this costs can be defrayed.
How long will it take?It can take anywhere from 45 to 60 days. Sometimes longer.
How much does it cost to evict a tenant?Often times the cost are under $2000 with certain limitations. How long before a tenant is evicted.Eviction is the forcible removal of an individual and or corporation. Only a Marshal can forcibly remove a tenant. The process begins with a notice to vacate or demand for rent, followed by the filing of Petition, and court appearances. This process can take anywhere from 4 to 8 months. Often even longer. It is best to act quickly upon a tenant's default.
How can I defend an eviction? If the case concerns non-payment. You can seek government subsidy. Or assert certain defenses such as the amount demand is not accurate. Or you have paid. You can also counter sue for defective conditions that the landlord is aware of and has an obligation to repair, but has not done so. In this instance you may be able to seek an abatement of rent; a reduction in rent. If the case is a holdover, You can raise issues with the living conditions, i.e. the need for repairs, lack of heat or hot water.
